Refund Policy

(1) This refund policy applies to the paid purchase of the virtual premium currency "Action$" (A$) and other paid digital services in the online game "Kickerscup".

(2) It summarises the refund-related provisions of our Terms & Conditions (§ 6 to § 8). The Terms & Conditions are authoritative and legally binding; in the event of any discrepancy, they prevail over this summary.

(3) Action$, Taler and other virtual items are digital content without any real monetary value. They cannot be exchanged back into real money and cannot be transferred or paid out to third parties.

(1) Paid orders are processed through our online reseller Paddle. Paddle is the Merchant of Record (seller) for these orders and therefore your contractual partner for the payment and purchase process. Paddle issues the invoice, handles customer enquiries regarding payment and processes refunds. The payment service provider is:

(2) The purchased digital content (crediting of Action$, unlocking of features) is provided in your user account after payment confirmation. The provider is responsible for the technical provision within the account.

(3) If a paid service is not provided after successful payment, you may contact the provider regarding provision and Paddle regarding payment and refund. The provider will support you in resolving the matter.

(1) Consumers have a statutory right of withdrawal for paid orders. The addressee of the withdrawal is the Merchant of Record (Paddle); the provider also accepts withdrawals and forwards them without undue delay.

Withdrawal instructions

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (Kickerscup, Jan Steiger, Ober-Ramstädter-Weg 52, 64846 Groß-Zimmern, email: info@kickerscup.de) or Paddle.com Market Ltd of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form printed in the annex to the Terms & Conditions, though this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments made in connection with the withdrawn order without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal. For this reimbursement we use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.

The right of withdrawal expires early for a contract for the supply of digital content not on a tangible medium (e.g. Action$) if performance of the contract has begun after you have

• expressly consented to performance of the contract beginning before the end of the withdrawal period, and
• confirmed your acknowledgement that, by giving this consent, you lose your right of withdrawal upon the start of performance (§ 356 (5) BGB).

This consent and acknowledgement are obtained and documented during the order process. Since Action$ are provided immediately after purchase and credited to your user account, your right of withdrawal expires in this case upon the start of performance. Irrespective of this, the voluntary 14-day refund guarantee under section 5 always applies to you.

(1) Irrespective of whether the statutory right of withdrawal has expired early under section 4, we voluntarily grant you a 14-day refund guarantee: within fourteen days of the date of the purchase confirmation you may request a refund of your order without giving any reason, provided the Action$ purchased are still unused in your user account at that time.

(2) If you have already used part of the Action$ purchased within the game, we refund the portion of the purchase price attributable to the remaining, unused Action$. The refunded Action$ are deducted from your user account at the same time.

(3) Action$ already used within the game are excluded from this voluntary guarantee, because the digital service received in return has already been fully performed.

(4) An informal message stating your order or invoice number sent to info@kickerscup.de is sufficient; you may also contact Paddle as Merchant of Record directly. The reimbursement is made using the same means of payment you used for the order.

(5) We grant this guarantee voluntarily and in addition. Your statutory rights, in particular the right of withdrawal under section 3 and the warranty rights under section 6, are not restricted by it.

(2) The statutory warranty rights for digital products (§§ 327d, 327i ff. BGB) remain unaffected. If a paid service is defective, you may, in accordance with the statutory requirements, demand subsequent performance, a price reduction or termination.

(3) Action$, Taler or virtual items that have already been used or deployed within the game are excluded from a voluntary refund. Statutory claims remain unaffected.

(4) Insofar as the right of withdrawal under sections 3 and 4 has effectively expired early, there is no statutory claim to a refund to that extent; the voluntary 14-day refund guarantee under section 5 and the statutory warranty rights remain unaffected.
